Announced today in New York, the 31st Annual Daytime Emmy Awards honored Martha Stewart Living with nominations in the following categories:

Since the program's debut in 1993, Martha Stewart Living has been honored in the Creative Arts Category with ten Daytime Emmy Awards: "Outstanding Directing in a Service Show" for the 1997-98 broadcast season, "Outstanding Service Show Host" in the 1994-95, 1996-97, 2001-02, and 2002-03 broadcast seasons, and "Outstanding Service Show" in the 1994-95, 1998-99, 1999-2000, 2000-01, and 2002-03 broadcast seasons. NEW YORK, Feb. 13 /PRNewswire-FirstCall/ -- Martha Stewart Living Omnimedia, Inc. (MSO) announced today that Kmart Corporation has filed an action with the United States Bankruptcy Court, Northern District of Illinois, Eastern Division, against MSO IP Holdings, Inc., a wholly owned subsidiary of MSO, seeking declaratory and other relief under the June 2001 contract between Kmart and MSO IP. This contract provides for two types of guaranteed royalty payment: the first based upon aggregate sales of all licensed products; and the second based upon sales by individual product categories. Kmart now seeks to interpret the agreement in a manner that would require them to make minimum royalty payments for the remaining life of the contract based solely upon aggregate sales of licensed products. As a result, Kmart specifically seeks to reduce the total guarantees due to MSO IP for the 12 months ended January 31, 2004, from approximately $52.0 million to $47.5 million, or approximately $4.5 million. In addition, Kmart seeks to reduce by approximately $1 to $2 million annually the amount it is obligated under the contract to spend with MSO on advertising in MSO media properties. MSO believes that Kmart's interpretation is inconsistent with the terms of our long-standing contract, and therefore intends to defend this action and enforce the terms of the contract.

Martha Stewart Indicted for Obstructing Justice and Making False Statements in Insider Trading Case of ImClone Stock6-6-03. Domestic Queen Martha Stewart, 61, was indicted by the federal government on nine counts and released withoug bail after surrendering to federal authorities. She and her former stockbroker, Peter Bacanovic, are accused of obstructing justice and making false statements. For over a year, the question has been whether or not insider tips helped her avoid a loss in her investment. Stewart is a former stockbroker and New York Stock Exchange director. James B. Comey, the U.S. Attorney for the Southern District of New York, thinks “this criminal case is about lying, lying to the FBI, lying to the SEC, and lying to investors.” The federal government did not charge Stewart with insider trading charges. That will be the focus of a civil suit by the Securities and Exchange Commission. They believe she received an illegal tip. This will be hard to prove because it is a matter of “he said, she said,” and there is no paper trail. After her indictment, Martha Stewart resigned her position as chairman and CEO of her company, Martha Stewart Living Omnimedia. So far, in Marth Stewart’s insider trading legal woes, the public has been behind her. She recently proclaimed her innocence and posted a letter saying so on a new Web site and in the “USA Today” newspaper. According to Stewart, she did not lie to investigators when they questioned her about her December 2001 sale of 3,928 shares of ImClone Systems Inc. stock a day before a regulatory setback. She says she “simply returned a call from my stockbroker.” In the letter, Stewart says “based in large part on prior discussions with my broker about price, I authorized a sale of my remaining shares in a biotech company called ImClone. I later denied any wrongdoing in public statements and in voluntary interviews with prosecutors. The government’s attempt to criminalize these actions makes no sense to me.” Stewart faces 30 years in prison if she is convicted.
